K3  MARRIAGE VISA


Eligibility for the K3 petition and K3 marriage visa

 

 

    

1.                  You must be a citizen. 

2.                  Have a lawful marriage.  If the marriage occurred abroad the marriage must be a lawful marriage recognized by the government. 

3.                  If you or your spouse were previously married, you must demonstrate that all previous divorces are finalized. 

4.                  For the K-3 visa you must also demonstrate that you meet the public charge requirements and most US Embassies suggest that you complete form I134 (Affidavit of Support ) to determine whether or not you will be able to financially support your spouse. 

5.                  Your spouse must also be admissible to the and examples of these ineligibilities are:  (if one of the below grounds of admissibility apply contact an immigration attorney)

 

      • engaged in prostitution, submitted fraudulent documents,
      • attempted to overthrow the government,
      • has HIV/AIDS,
      • overstayed her visa
      • practicing polygamy
